    <summary type="text">Title: Analysis of SPC Regulation Associated with Pharmaceutical Products in Europe

Abstract: The purpose of the study is to understand SPC regulations associated with pharmaceutical products. The study focuses on the case laws associated with SPC regulation and decisions handed down by national IP courts across Europe. The study also provides some guidelines for patent claim drafting with improved chances of getting and identifying avenues for challenging SPCs, as well as possible solutions and loopholes in SPC regulation. The guidelines for predictions of generic drug entry into market are discussed. The data collected and analyzed for individual European Country provides useful insight into pattern of SPC filing, grant and SPC invalidity. It is observed that there is a need to amend SPC regulation to provide better clarity to both innovators and generic drug industry.

Abstract: Prior-art-search is a critical activity carried out by intellectual property professionals. It is usually performed based on known source of literature to ascertain novelty in a said invention. Prior-art-searches are also carried out for invalidating a patent, knowing state of the art, freedom to operate studies etc. In many technological domains such as chemistry, mechanical etc., prior art search is easy as compared to domain such as software. In software domain, prior-art can prove to be a complex and tedious process relying heavily on non-patent literature which acts as a pointer to the current technological trends rather than patent documents. This paper tries to highlight the issues faced by patent professionals while performing prior-art search in the field of software patents.

Abstract: The infringement of intellectual property rights (IPRs) in the form of counterfeiting has emerged as one of the biggest crimes of the contemporary world. Counterfeiting has become a global epidemic, creating huge losses to the established brands, economy of a nation, undermining innovation and creativity and posing a significant threat to consumer health and safety. In recent times, it has become the world’s fastest growing and most profitable business. To combat counterfeiting, a detailed investigation from the consumers demand perspective is required as the universal law of economics states that “where there is a demand, there will be a supply”. The main aim of the study is to identify the key psychographic determinants affecting consumers’ buying intentions of purchasing counterfeit products in India. The main findings of the study revealed that price consciousness, novelty seeking, status consumption and peer pressure are the key psychographic determinants affecting consumers’ buying intention of purchasing counterfeit products. It has also been found that value consciousness has no influence on consumers’ buying intention of purchasing counterfeit products. The study is relevant to the current marketing scenario as it provides useful insights to the brand manufacturers and marketers for developing effective strategies and policies required to influence consumers’ buying intentions of purchasing counterfeit products.

Abstract: In educational fields, misconducts are common now-a-days and one of the academic misconduct is piracy, which discourages the real owners, real creators, real researchers and real inventors. Greed for earning more money in a short duration of time and application of technologies are the major factors of piracy. Technology makes every work faster and easier in one side and in other side misconducts are increasing tremendously because of these technologies, which are enough to threat the educational systems. Piracy is a global issue, so the Government of various countries is trying to amend the existing laws and also trying to enforce some new laws to trace and to punish the pirates. Piracy is growing in the world academic community very severely. Hence, a proper knowledge on piracy is important. This review discusses on various aspects of piracy including its origin, definitions, limitations, consequences, causes, detection etc. In view of piracy for commercial and non-commercial purposes, it is tried to discuss certain circumstances under which one pirates a book or similar works. This review would help academicians, researchers and students to stay away from piracy as well as to overcome piracy.
